You know what?….

I am going to speak to you from a Black Woman’s perspective.  I think someone has to set things straight and it’s not going to come from an ETHNIC ………………..God I hate that word:(

I find it amusing that people only seem to remember that Black people and non-White people of various linguistic persuasions, exist once the Elections roll around.

I have lived in Canada and in Quebec and in the Montreal Area for 43 years — I have never lived anywher else on this Planet, yet in every Coffee House (Cafe) that I have frequented in the past 20 years as a resident of Montreal I have heard the same argument.

” The ‘Ethinics’ want to benefit from all that Quebec has to offer them, but they don’t want to support the PARTI that makes all these opportunities a reality for them'”

In other words  the Parti Quebecois has the interests of all Quebecers in mind including the interests of the Ethnics —and the Ethnics take from Quebec, but when Election time comes around, they support Political Parties that do not have their best interests in mind. (in otherc words, non-PQ Political Parties don’t care about Ethnics in Quebec)

The assumption is that the so-called Ethnics living in Quebec are not educated not sophisticated enough to make informed decisions about which Political Party would better serve their communities and serve their needs as individuals.

Not only is this highly insulting, it is very untrue. I think that we may be apathetic, but not necessarily uneducated about the political issues that are important to the proper functioning of our Democracy and which political decisions would be best for us as individuals.

Why on Earth would us Ethnics want to participate in a Political System that pulls us out like props fro the Pirates of Pensance everytime someone wants to secure an Election vote?

Yes, we do know when we are being used and yes,…we do not appreciate it.

We are not the invisible minority we are the visible majority and there is power in numbers.

If we have not voted for you it is not out of ignorance, it’s because you have not offered us anything worth sinking our teeth into.

Applying Law to our everyday lives.

There is an English expression about knowledge… “Knowledge is Power”

However, I believe that knowledge becomes power only when one has the tools to use this knowledge effectively. This is where integrity plays an integral role. This is where knowing right from wrong is so important.

The easiest way for me to learn something new is to relate it to my own life.

Knowledge has to leave the pages of the book or the computer sceen or Notebook and become animated in my everyday life…  Then it makes perfect sense!

So after spending time at the Free Legal Fair at Complexe Desjardins in Downtown Montreal, Quebec, Canada, today I decided to take what I have learned and try to give it an everyday spin.

I am not a Lawyer so I will not be giving any legal advice or any legal interpretation of any laws.

This Blog entry will just be my ideas about the laws I learned about today, as a layperson who finds law interesting.

The Charter of Human Rights and Freedoms: An Expression of Social Values in Quebec, Canada.

The main goal of the Charter is to harmonize the relationships of Québec’s citizens among themselves and with their institutions, in a context respectful of human dignity.

The preamble to the Charter lays the foundations for harmony by calling for mutual respect and reciprocity:

  • All human beings are equal in worth and dignity, and are entitled to equal protection of the law.

 REAL LIFE:

But as we stand in solidarity with brothers and sisters in Wisconsin, we do so in the knowledge that theirs is not a struggle confined to a single US state. Nor – as the neoliberal strategy of Governor Walker stretches to other states – is it a uniquely US problem. It is a global problem, demanding a global response.

European workers too are seeing the erosion of hard-won collective bargaining rights, also as a result of the greed of the bankers, who have emerged from the financial crisis unscathed. In the UK the erosion of bargaining rights is taking place by stealth. Although collective bargaining machinery still exists in local government for example, friends in public service unions tell me it is a long time since they had a collective agreement on pay or on other terms and conditions of employment.

 You can’t make this kind of stuff up folks. Just as the title states, it would appear that while attending a rally for Stephen Harper, a UWO student was recognized by security as an “Ignatieff supporter” because her Facebook display picture is of herself, a friend, and the Liberal leader.  I’m not sure how many people attended this rally in total, but I commend Harper’s security staff for their expert Facebook creeping skills. It’s 2011 ladies and gentlemen. All haters will be dealt with swiftly, publicly, and in a manner that discourages the next generation of voters from participating in the democratic process. Awesome.

The Quebec Human Rights Tribunal has ordered a Montreal man to pay his gay neighbours $12,000 for allegedly subjecting them to “homophobic comments,” death threats and invitations to fight, even though he was acquitted of the charges in a court of law nearly five years ago.

McGill Fined for M.B.A. Tuition Hike

Whenever I mention in this country that I went to college in Canada, I am almost invariably met with the response, “McGill?”  I have often wondered why that is so.  I mean, it is true that McGill has been ranked the top university in Canada by the country’s leading news magazine five years in a row, and Montreal is a great city, but I have come to the conclusion that the real reason is the name.  It just sounds a whole lot more prestigious than, say, the University of Toronto, which is generally acknowledged to be most excellent.  But the truth is that Canada does not have the same sort of distinction between public and private universities that exists in the U.S., and that largely accounts for the great discrepancies in cost in this country.

In Canada, all universities are subsidized by the government of their province.  When they accept these subsidies, they have to agree not to charge students more than provincially-established tuition rates.  In this sense, they are all state schools.  This year, the undergraduate tuition rates at McGill are $3,500 for Quebec residents, $7,100 for other Canadian residents, and between $15,500 and $24,500 for international students.  (In Canadian dollars, which is currently trading a little less than two cents above the U.S. dollar.)  Rates at other universities in Canada are generally a little higher, but even the highest undergraduate average in Canada is the relatively paltry (compared to the U.S. that is) $6,300 in Ontario.

Calling it an “unbelievable case of concealment,” officials are trying to determine how a young Asian man in Hong Kong was able to disguise himself as an elderly Caucasian man and slip onto a Canada-bound flight.

It is believed that the man managed to get on the plane with only a boarding pass and Aeroplan card, both of which belonged to a 55-year-old U.S. citizen.

The unnamed young man at the centre of the curious case, which occurred late last month, is currently in detention in Vancouver following a refugee claim.

DISCRIMINATION AND HARASSMENT

 What is discrimination?
Discrimination prohibited under the Charter exists when:
 
 this distinction, exclusion or preference is based on one of the grounds set out in section 10 of the Charter;
  • this distinction, exclusion or preference deprives you of the right to equality in the recognition and exercise of your human rights and freedoms.

 

The discrimination may be:

  • direct (for instance, you are dismissed because you are Black or Asian);
  • indirect (for example, a company’s hiring standards result in your being excluded because of your near-sightedness);
  • systemic (as a result of the overall policies and practices of a company, for example, a disproportionate number of women are excluded, or prevented from progressing within the company)

(CBC)Concordia University student Amal Asmar plans to file a complaint against Montreal police, alleging she was mistreated by officers and fined $1,000 after being targeted because she is of Palestinian descent.

Montreal police refused to comment on the case, but the force has maintained that racial profiling is against its official policy.

Asmar, 33, a human relations and psychology student, said she was on her way to a friend’s house after a late night of studying for midterms at Concordia’s library on Feb. 4.

She said she stopped and sat down on a bench at a bus stop on Ste-Catherine Street outside the Alexis Nihon plaza at about 3 a.m., when a police cruiser pulled up and two male officers began questioning her.

The S.W.A.P. Team is a non-profit social enterprise with an international presence. It is the creator of “Take Off Your Clothes” – a giant clothing swap for charity.

Since its launch in June 2009, The S.W.A.P. Team has formed chapters in Montreal, Boston, Ottawa, Toronto, Vancouver, Calgary, Halifax, Northampton (MA), NYC, and is ever-expanding.

Our mission:
1. Provide good quality clothing to charities, who then use the clothes for their local community programs
2. Provide communities with an alternative to new clothing consumption
3. Promote eco-friendly and socially conscious clothing consumption

An active blogger, Necole writes about her love for fashion and all things creative. When she interviewed The S.W.A.P. Team for her blog in the fall of 2009, she became hooked on the concept of “eco-friendly swap shopping.” Necole plans to share her love of community, fashion and music by heading up Calgary’s first ever Take Off Your Clothes event in spring 2010. WINNIPEG — A Winnipeg lawyer accused of pressuring a client to have sex with his wife — who is now a Manitoba judge — has pleaded guilty to three counts of professional misconduct.

Jack King accuses Alex Chapman of violating a 2003 confidential settlement and is suing on claims his privacy was breached.

Jack King was accused of trying to coerce a man into having sex with Lori Douglas in 2003.

Alex Chapman said King sent him explicit nude photos of Douglas, who was a lawyer at the time in the same firm as King. She was named a Queen’s Bench justice two years later.

King appeared before the Law Society of Manitoba on a charge of professional misconduct on Monday and was handed a reprimand.

The law society agreed to a joint recommendation by King’s lawyer and counsel for the society not to issue a suspension.

It also decided that no fine was necessary. The reprimand — a “permanent blemish” on his record — was enough, the law society decision said Monday.

King has admitted sharing photos with Chapman, but King’s lawyer has said his client was depressed at the time and acting without his wife’s knowledge.

He apologized to the law society, saying that his wife had been hurt by “privately indulging” him, and she had done “nothing wrong.” He said his behaviour had caused him to be the subject of ridicule.

Following Monday’s hearing, Chapman said he was dismayed King did not directly offer him an apology. He said King was still “portraying” himself as a victim.

Douglas is being investigated by the Canadian Judicial Council and has stopped hearing cases until the review is complete.

The charges related to three different sections in the law society’s code of professional conduct. One prohibits sexual harassment.

The second and third relate to “putting your own interest ahead of the lawyer’s duty to protect the client” and “(requiring) a lawyer to conduct himself with integrity,” according to a document provided by the law society. Lawyers who are convicted of professional misconduct could face penalties including a disbarment or a fine.

Complainant seeks $67M

Chapman has made a separate complaint to the Manitoba Law Society about King’s alleged conduct.

On Wednesday, Chapman filed separate lawsuits against King for $10 million and against Douglas for $7 million. He is also suing the law firm Thompson Dorfman Sweatman, where the couple used to work, for $50 million.

He told CBC News on Wednesday that he couldn’t live with what he says happened any longer.

“I’m standing here at the courthouse and I’m very nervous … I’ve been like this for seven years,” he said.

“I just want people to know that this happened to me and it was real for me.”

He said he was relieved to have his story out in the open.

A man embroiled in a controversy over nude photos of a Manitoba lawyer who is now a judge is back in court in Winnipeg.

Alex Chapman is fighting to keep his $10-million lawsuit against lawyer Jack King from being dismissed.
